It's probably a number of factors like are they doing bank fraud and money laundering like the other big 3 were accused of doing ... IDK the answer to that ... maybe yes maybe no

The second thing to consider is they are relatively small ... DOJ has a limited budget and it might not be worth it to spend their resources going after a small operation.
