I was reading about this earlier today. From what I gathered there isn't much of a case here. Big home cash games have been going on in Hollywood for years and years. If these homes games were collecting a rake then they would be illegal ... if there was no rake then they would be legal. Something tells me Tobey wasn't collecting rake here... just a guess.
